Terms of Service

Welcome to ViralDNA. These Terms of Service ("Terms") govern your use of the ViralDNA mobile application and any related website, content or services we provide (collectively, the "Service"), operated by ViralDNA ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

If you do not agree, please do not use the Service.

1. Eligibility & accounts

You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed these Terms.

The app creates a device-bound account for you when you first use it. To keep your analyses across devices and to use a paid subscription you must secure that account by signing in with Apple, Google, or an email and password. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us at support@viralcodeapp.com if you believe your account has been compromised.

2. The Service

ViralDNA analyzes short-form videos and photo carousels that you submit by link or upload. It extracts evidence from the content — such as a transcript, scene timings, on-screen text and pacing metrics — and produces a report with scores, an estimated retention curve, timestamped insights and ideas. The exact set of features and limits may evolve over time.

We reserve the right to add, remove or modify features at any time. We will use reasonable efforts to notify you of material changes that affect your paid subscription.

3. Subscriptions, trials & billing

Subscription required

Using the Service requires an active subscription. Two plans are offered inside the app: a monthly plan and a yearly plan. Prices are shown in the app in your local currency before you subscribe.

Free trial

The yearly plan may include a free trial (currently 3 days) for new subscribers. At the end of the trial your subscription begins and the payment method on file with the Apple App Store is charged automatically, unless you cancel at least 24 hours before the trial ends. A trial is available once per account.

Billing through the App Store

All purchases are processed by Apple, subject to Apple's Media Services Terms and Conditions. We do not see, store or process your payment details. Subscriptions renew automatically at the price shown at sign-up unless cancelled at least 24 hours before the end of the current period.

Cancellation & refunds

You can cancel at any time in iOS: Settings → [your name] → Subscriptions → ViralDNA. Cancellation takes effect at the end of the current billing period, and you keep access until then. Refunds are handled by Apple under its policies; we cannot issue refunds directly for App Store purchases.

Price changes

We may change subscription prices going forward. Any change will be communicated in advance and applies only to renewals after the change; you may cancel before the new price takes effect.

4. AI-generated analysis — no guarantees

Reports, scores, insights and ideas are produced with the help of third-party artificial-intelligence systems working from evidence extracted from your content. We design the pipeline so that scores are computed from measured metrics and AI output is validated, but AI can still be inaccurate, incomplete or miss context.

ViralDNA does not predict virality, views, engagement or revenue, and does not guarantee any outcome for content you post. The retention curve is an estimate derived from the video itself; it is not platform analytics.

The Service is provided for informational and creative purposes only and is not professional, legal, financial or marketing advice. You are responsible for the decisions you make about your content.

5. Your content & third-party content

You keep all rights to the videos, images and links you submit. You grant us a limited, worldwide, non-exclusive licence to store, copy, process and transmit that content, and to derive transcripts, frames, metrics and reports from it, solely to provide the Service to you.

You may submit links to publicly available content made by others. Extracted assets, frames and transcripts are provided for analysis and reference only. Analyzing content does not give you any right to reuse, republish or monetise it, and you are solely responsible for complying with copyright and platform terms in how you use anything the Service surfaces. You represent that you have the right to submit any content you upload from your device.

If you are a rights holder and believe content should be removed from our systems, contact us at support@viralcodeapp.com.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or platform terms.
  • Submit content that is illegal, sexually explicit involving minors, or that you do not have the right to submit.
  • Circumvent plan limits, rate limits, authentication or other access controls, or share an account.
  • Reverse-engineer, decompile or attempt to extract the source code of the app, except as expressly permitted by applicable law.
  • Probe, scan or test the vulnerability of any system or network of the Service, or interfere with or impose an unreasonable load on our infrastructure.
  • Use the Service to build a competing product, train a machine-learning model, or assemble a dataset for resale.
  • Use automated means to submit content or extract reports at scale without our written permission.

7. Intellectual property

The Service — including its code, design, branding, scoring methodology, prompts and original imagery — is the property of ViralDNA and its licensors and is protected by copyright, trademark and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own content work, subject to these Terms.

You may use the reports the Service generates for your own content and share them with your collaborators. Beyond that, you may not reproduce, distribute or create derivative works of the Service without our prior written consent.

8. Third-party services

ViralDNA relies on third-party services to deliver the product, including Apple (sign-in and billing), Google (sign-in), AI providers for speech-to-text, vision and language models, media-fetching infrastructure and cloud hosting. Each has its own terms and processes data as described in our Privacy Policy. We are not responsible for third-party services beyond our integration with them, nor for the platforms (TikTok, Instagram, YouTube and others) whose public content you choose to analyze.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. We do not guarantee that any link can be fetched, that any analysis will complete, that reports will be error-free, or that the Service will be available at all times.

10. Limitation of liability

To the maximum extent permitted by law, in no event will ViralDNA, its founders, employees, contractors or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, audience, data, goodwill or other intangible losses, arising out of or relating to your use of the Service or any content you publish after using it.

Our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid ViralDNA in the twelve months preceding the claim, or USD $50, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages — there, the limitations above apply only to the extent permitted.

11. Indemnification

You agree to defend, indemnify and hold harmless ViralDNA and its affiliates from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, content you submit, your misuse of the Service, or your violation of any law or the rights of a third party.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use is harmful to other users, third parties or the Service. We will use reasonable efforts to notify you when feasible.

You can delete your account at any time from inside the app (Profile → Delete account). This removes your account, media and reports as described in our Privacy Policy. Deleting the account does not cancel an App Store subscription — cancel that in iOS Settings.

13. Changes to the Service or these Terms

We may update these Terms from time to time. If the changes are material, we will notify you in the app or by email at least 14 days before they take effect. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
